Property Practice and Land Law: Taming the FLK2 Beast
FLK2 quietly fails more candidates than FLK1, and Property is a big reason why. It is procedure heavy, detail rich, and easy to skim because it feels less like classic law and more like a process. That is precisely the trap. Treat Property as a story you can follow and it becomes one of your most predictable sources of marks.
Follow the transaction from start to finish
Property Practice is really the life of a conveyancing transaction. Learn the stages in order and the detail has somewhere to live.
- Pre-contract: taking instructions, investigating title, raising and reviewing searches and enquiries.
- Exchange of contracts: when the parties become legally bound, deposits, and the consequences of exchange.
- Pre-completion: final searches, requisitions, and preparing to transfer.
- Completion: money moves, the transfer takes effect, keys change hands.
- Post-completion: stamp duty land tax, and registration at the Land Registry.
When a question lands, place it on this timeline first. Knowing the stage instantly narrows which rules apply.
Do not neglect the Land Law underneath
Property Practice sits on top of Land Law, so the two reinforce each other. Make sure you are solid on freehold and leasehold, co-ownership, easements, covenants, and the difference between registered and unregistered land. The practice questions make far more sense once the underlying land law is secure.
Property rewards candidates who know the order of events. Many questions are simply asking "what happens at this stage, and what could go wrong here?"
Watch the classic trouble spots
- Searches and enquiries, and what each one reveals.
- The significance of exchange, and the risk gap before completion.
- Stamp duty land tax and registration deadlines after completion.
- Leasehold specifics, which carry their own layer of rules.
Study it actively, in order
Resist the urge to passively read the Property chapter once and hope. Work through scenario questions that march along the transaction, and after each one, place the issue on the timeline in your head. Repetition along that sequence is what turns Property from a feared beast into reliable, bankable marks. Give it the dedicated time it deserves and you protect your whole FLK2 result.
